Paternity Actions
Mother and Father may have never married, but had a child together out of wedlock. Paternity is the legal process to determine the father-child relationship and child custody schedule when a child is born out of wedlock. Many times the identity of the father is known, but the filing of a paternity action is still required to resolve issues related to child custody, visitation, child support, and birth related expenses. When the identity of the father is uncertain, paternity actions are used to establish the identity of the father through genetic testing, also known as DNA tests.
Paternity actions are frequently contested because Mother and Father often times do not reside together, but each parent is fighting for child custody. Child support also becomes a contested issue.
